A power of attorney letter arranged and undersigned by an Iranian National becomes a valid document for submission to Iranian Offices, upon receiving approval by the Embassy of the I.R.I.
According to Article 210 of the Civil Code, regarding all contracts, transactions and obligations, both parties involved in the power of attorney, must be competent to transact the business. If any party of the contract is semiconscious, suffers from attention deficit disorder, amnesia, or for any reason does not possess a reasonable amount of consciousness for determining his own interests, then he or she is not qualified for making a contract.

Important notes on preparing a power of attorney (POA)

  • The POA must be void of any scribbles and scrawls
  • It is mandatory to inscribe the full and accurate personal details and address of residence of the principal (person who authorizes the other to act on their behalf) as well as that of the agent, (person who acts on behalf of the principal), including the exact list of authorities (acts) that the principal is delegating to the agent, in the POA.
  • For issues concerning marriage and divorce, the principal must mention the phrase “I hereby bestow the agent the authority to delegate his/her authority to any other agent/attorney (if required)” in the content of the POA, so as to clearly set out the authorities delegated to his agent, such that if necessary he/she would be easily able to delegate his/her authority to another agent. In other cases, the mention of aforementioned phrase is not mandatory but an option for the principal.
  • The address of the principal and that of the agent must refer to the exact place of their residence. Typically the addresses of principals living abroad, is inscribed in English, and that of the agent residing in Iran, naturally in Farsi.
  • Normally the inscription of the “Matter with regards to which authority is delegated” and “Scope of Agent’s Authority” is the responsibility of the Principal. In order to guarantee the sufficiency of the POA, it is recommended that the text be first received by the agent in Iran, and inscribed at the relevant venue. POAs delegating entire authority to an agent, are inadmissible, and all of authorities must be separately and accurately declared in the POA.
    In order to give our dear compatriots a clearer idea of POAs, we have provided you with a list of various types of POAs, as suggestions. They may be used upon applicant’s (principal’s) request, given they correspond to your his/her needs and conditions. Otherwise, the principal may use POA [no.230], where the fields “Matter with regards to which authority is delegated” and “Scope of Agent’s Authority” should be arbitrarily filled-out.

    POAs must be undersigned by the Principal, at the Embassy, and in the presence of the relevant officer.
  • NOTE: Before undersigning, determine clearly what authorities you want to delegate to another individual and try to completely inform yourself about the consequences. Moreover, never sign a POA, when you are not fully aware of its entire context and consequences of the delegation of your authorities to the other party.
